The Path of the Law

Oliver Wendell Holmes Jr.’s *The Path of the Law* is a landmark essay, originally delivered as a lecture at Boston University Law School in 1897 and widely reprinted as a short book. Holmes, then a Massachusetts Supreme Judicial Court justice and later a U.S. Supreme Court justice, argues that law should be studied from the standpoint of the “bad man,” who cares only about the material consequences of legal rules rather than moral duty. This predicted-consequences approach defines law as nothing more than a prophecy of what courts will do in fact. The essay’s central frameworks include the distinction between law and morality, and the separation of legal duty from moral obligation. Holmes contends that terms like “rights” and “duties” are misleading when treated as moral absolutes; legally, a right is merely the permission to act or demand that courts will enforce.
